Terms and Conditions

Domain Name Registration

We can organise your domain name registration on your behalf. The domain name will be registered in the client’s name or business name where applicable. Ongoing renewal fees will apply in accordance with the registration term selected, including any 2-year renewal period where applicable.

Content Provision

All text, images, logos, and other content must be supplied by the client in electronic format. Text content should be proofread and approved by the client before submission. Any additional copywriting, image sourcing, photography, or content creation required for the website will be charged separately.

Editing Fees

If the client requests changes to text, images, or other content already submitted, additional editing fees may apply. Minor edits may incur a fee of $50 per page or per edit request, depending on the nature of the change.

Scope of Work and AI-Generated Requests

Website packages are delivered strictly in accordance with the inclusions listed in the client’s quote or proposal.

Any additional requests, revisions, or changes arising from AI-generated advice, design checklists, website graders, SEO audits, or third-party marketing recommendations are considered outside the original scope of work and may incur additional charges.

Clients are encouraged to provide their own written content and imagery. Layout, formatting, and styling will be completed based on the structure, design style, and example website link provided by the client, unless otherwise agreed in writing.

Copyright Responsibility

The client is solely responsible for ensuring they have permission to use all content supplied to us, including but not limited to photographs, graphics, logos, videos, music, and written text. InStyle Web Design accepts no responsibility for copyright infringement arising from material supplied by the client.

Ownership

Upon full payment of all invoices, the client owns the website content they have supplied, including their images and text. The website files installed on the client’s hosting account are for the client’s use, subject to any third-party software, theme, plugin, font, stock image, or licence restrictions.

Payment and Invoicing

A 50% deposit is required before work commences. The remaining balance is due upon final delivery of the completed website, prior to handover or launch unless otherwise agreed in writing.

Payments may be made by direct deposit or PayPal.

If an invoice remains unpaid for 10 days after the due date, a $20 late fee may be applied. If payment is not received within 21 days of the due date, hosting and related services may be suspended, restricted, or terminated.

Delivery and Development Timeframes

Estimated project completion is generally within 2 weeks from commencement, provided the client supplies all required content, feedback, and approvals promptly.

Any delays in receiving content, approvals, or required information from the client may delay the completion date.

Additional requirements, including but not limited to extra forms, custom functionality, advanced search features, booking systems, integrations, ecommerce features, or other complex items, are not included unless specifically stated in the quote and may be quoted separately.

Email Setup

We can create and configure email accounts within the hosting control panel where included. It is the client’s responsibility to update their devices and email software settings correctly. Assistance can be provided if required and may be charged separately where the setup extends beyond the original inclusions.

Hosting Requirement

We only build websites that are hosted on our servers or hosting environment. Clients must purchase one of our hosting plans if they would like us to build and maintain their website, unless otherwise agreed in writing.

Password Security

The client is responsible for maintaining secure passwords for all website, hosting, and email logins. If insecure or weak passwords are used and pose a security risk, we reserve the right to request that passwords be updated or, where necessary, suspend access until the issue is rectified.

Acceptable Use

The client must not use our hosting, email, or website services for any unlawful, offensive, fraudulent, or prohibited activity, including copyright infringement, trademark infringement, malicious activity, or the distribution of unlawful material.

Any use of our services for spam, bulk unsolicited email, malware, phishing, abusive conduct, or other harmful activity is strictly prohibited and may result in suspension or termination of services without notice.

Spam Policy

We maintain a zero-tolerance policy on spam and unsolicited bulk email. Any account used to send spam, or that causes our mail servers or domains to be blacklisted, may be suspended or terminated immediately.

Clients are responsible for ensuring that any email marketing they send complies with applicable laws, including consent and unsubscribe requirements.

Backups and Data Loss

Server-level backups may be performed as part of the hosting service; however, the client remains responsible for maintaining their own copies of important website content, emails, and data.

Where a restore is possible, restoration work may incur an additional fee. InStyle Web Design is not responsible for data loss caused by client deletion, third-party interference, hacking, plugin conflicts, software corruption, or events outside our reasonable control.

Bandwidth and Resource Usage

Hosting plans include resource allowances appropriate to the selected package, including bandwidth where applicable. If the client exceeds the allocated allowance or uses excessive server resources, we reserve the right to suspend the account, require an upgrade, charge additional fees, or terminate the service.

Unused bandwidth or resources do not roll over to the next billing period.

Website Access, Third-Party Changes and Liability

Once website login details, hosting access, cPanel access, WordPress admin access, or backend credentials have been provided to the client or to any third party, the client accepts full responsibility for any changes made by themselves or by any other person or service provider they engage.

This includes, but is not limited to, SEO providers, marketing agencies, developers, virtual assistants, plugin installers, advertising managers, IT support, or other contractors.

InStyle Web Design is not liable for any issues, errors, conflicts, website damage, downtime, loss of functionality, plugin or theme conflicts, form issues, email issues, design breakage, malware, or performance problems caused directly or indirectly by third-party access, modifications, installations, updates, or configuration changes.

Any work required to investigate, troubleshoot, repair, restore, clean, or correct issues arising from such access or changes will be treated as additional billable work and charged at our standard hourly rate or quoted fee.

Limited Website Warranty

We provide a limited warranty of 14 days from the date of website handover or launch for defects directly caused by our work.

During this period, we will correct coding errors, broken functionality, or configuration issues that are directly caused by the services we provided, at no additional charge.

This limited warranty does not apply to:

  • changes made by the client after handover
  • changes made by third parties
  • SEO work performed by third parties
  • plugin, theme, or software updates made after handover
  • hosting or server changes not made by us
  • hacks, malware, brute-force attacks, or security breaches
  • issues caused by third-party software, services, or platforms
  • content edits, layout changes, or new functionality requests not included in the original scope

Any repair or support work outside this limited warranty period, or outside the scope of this warranty, will be charged separately.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies the client may have under the Australian Consumer Law.

Disclaimer and Limitation of Liability

InStyle Web Design will use reasonable care and skill in providing its services. However, to the maximum extent permitted by law, we do not guarantee that hosting, email, website functionality, third-party software, or third-party services will be uninterrupted, error-free, or free from security risks at all times.

To the maximum extent permitted by law, InStyle Web Design will not be liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of business opportunity, loss of data, or business interruption arising from the use of our services, third-party outages, software failures, hosting interruptions, or client or third-party changes.

Nothing in these Terms excludes, restricts, or modifies any non-excludable rights or remedies, including those under the Australian Consumer Law.

General

These Terms and Conditions apply to all website design, hosting, maintenance, and related services supplied by InStyle Web Design unless otherwise agreed in writing.

By paying a deposit, approving a quote, or using our services, the client is deemed to have accepted these Terms and Conditions.
